1. Preface and Context

Core to the fundamental principle of SACCAWU is socialism which is the backbone of equality, access and distribution of resources. Our responsibility extends to ensuring fair labour practices and standards in life cycle of workers: from recruitment, appointment, contracting, remuneration, representation to retirement and retirement benefits.

2. What the Legal Department does

The legal department is central and strategic to the mandate of the organisation, it works tirelessly to protect, defend and advance the rights of workers (e.g. job security and working conditions, fight exploitation and discrimination).

They provide legal advice, support and representation for their members during disputes with employers in internal hearings, conciliations, arbitrations and litigation proceedings at CCMA, Bargaining Councils, Labour Court, Labour Appeals Court, Constitutional Court and Competition Commission or Tribunal. And manage the risk by providing guidelines to ensure their members engage in protected strikes and picketing in advancement of workers’ rights.

They ensure the union’s integrity is upheld by making sure the union is democratic, transparent and compliant with the legislations and the law.
